Abstract
Rad prikazuje proces razvoja potrošačkog prava na području Sjedinjenih Američkih Država te Europske unije. Pravna stečevina Europske unije je imala izniman značaj na razvoj nacionalnog zakonodavstva u RH kojim se uređuje zaštita prava potrošača zbog potrebe usklađivanja i implementacije Direktiva EU o zaštiti prava potrošača u Zakonu o zaštiti potrošača i Zakonu o obveznim odnosima na području Republike Hrvatske. Temeljna teza rada je da potrošači imaju pravo na zaštitu jer su slabija ugovorna strana te manje informirana strana prilikom sklapanja ugovornih odnosa s trgovcima. Iz tog se razloga u Zakonu o zaštiti potrošača definiraju prava potrošača, uređuje se poslovanje trgovaca s potrošačima i sklapanje ugovornih odnosa između trgovca i potrošača. Zakon ujedno sadrži odredbe o procesnopravnoj zaštiti potrošača i institucionalnom okviru zaštite potrošača te inspekcijskom nadzoru i prekršajnim odredbama.
Abstract (english)
The paper presents the process of development of consumer law in the United States and the European Union. The acquis communautaire was of exceptional importance for the development of national legislation in the Republic of Croatia governing consumer protection due to the need to harmonize and implement EU Consumer Protection Directives in the Consumer Protection Act and the Civil Obligations Act in the Republic of Croatia. The basic thesis of the paper is that consumers have the right to protection because they are a weaker party and less informed party when concluding contractual relations with traders. For this reason, the Consumer Protection Act defines consumer rights, regulates the business of traders with consumers and the conclusion of contractual relations between traders and consumers. The law also contains provisions on procedural consumer protection and the institutional framework for consumer protection, as well as inspection supervision and misdemeanor provisions
